I, _________________________________________________________________________, (Print Your Name Here) (Hereinafter, called the "Client”), hereby request a reservation to breed the mare named below, to the stallion, BF Oliver Twist (WPCSA #A-40312), standing at Winding Oaks Welsh & Sportponies, in Morriston, FL, for the 2008 breeding season, on the following terms: 1. Client agrees to pay a non-refundable Booking Fee of $150 to Leah McFarlin with this Contract, and a Breeding Fee of $650. The Breeding Fee, plus all appropriate unpaid expenses, shall be paid to Leah McFarlin, prior to semen being shipped. This breeding fee will include the first collection & shipment (continental U.S. only, via FedEx) of semen. Counter to counter, same day, courier service is also available, at Client's expense. Any additional collections/shipments will be done at a cost of $150 per collection. Any additional shipping costs are payable by Client. Client may choose to use an Equitainer (or similar) shipper, by submitting a check for deposit, in the amount of $250. The check will be held and returned when use of container is complete. Otherwise, Client may elect to independently purchase a “clipper” type disposable shipper, and have it shipped directly to Winding Oaks Welsh. It must be received well ahead of the shipment date, so that the ice pack can be appropriately frozen. Any Client not returning an Equitainer, within 7 days of shipment, will be charged an additional rental fee of $20, per extra day the Equitainer is gone. Clients are encouraged to return the Equitainer using express shipment and insurance. Equitainers lost/damaged during return transit or the responsibility of the Client. 2. The Client represents and warrants that the mare to be bred is healthy and in sound breeding condition. If registered, a photocopy of the mare’s papers, showing both sides, must be furnished and returned with this contract. 3. The Client agrees to have the mare current on worming, vaccinations and to provide evidence of a clean uterine culture and cytology, before insemination. 4. All reasonable efforts will be made to settle the mare during the year of 2008. Should the mare fail to conceive, owner may opt to substitute another mare, or rebreed the following year. Dates when semen will not be shipped, include August 1 through December 31, 2008, unless by special arrangement (please inquire). 5. If the mare does not settle, or does not produce a live foal (one that stands and sucks), the Client shall be entitled to rebreed this mare the following year, on the terms and conditions provided in this contract, upon payment of the next year’s Booking Fee, collection fee and other expenses, but without payment of any further Breeding Fee. This obligation by Winding Oaks Welsh & Sportponies to re-breed will apply only if the client notifies Winding Oaks Welsh & Sportponies in writing, seven (7) days from the birth of a stillborn foal or within sixty (60) days of a miscarriage. A statement must accompany this notice, from a licensed Veterinarian verifying such facts. It is agreed that this provision will be of no further effect if the mare is taken to any other stallion before returning to BF Oliver Twist. If the client fails to desire a re-breeding the following year, any and all fees paid will be forfeited. The right to re-breed under this contract is thereby cancelled and Winding Oaks Welsh & Sportponies is released from any further obligation. 6. If BF Oliver Twist should die or become unfit for service, before the mare conceives, Winding Oaks Welsh & Sportponies shall refund the Breeding Fee to the client, within 3 months. Under no circumstances, other than stated above, shall the Breeding Fee be refunded. 7. Winding Oaks Welsh & Sportponies reserves the right to refuse to breed any mare for any reason. Should this occur, any stallion service fees will be refunded, minus collection fee, booking fee and various fees which may have occurred. 8. Winding Oaks Welsh & Sportponies can and will refuse to ship any additional shipments of semen, if Client does not return paperwork included with the initial shipment, verifying by a DVM, that the mare designated on the contract was inseminated and the date the insemination occurred. 9. A Breeder’s Certificate will be issued to the Client for a foal, when all fees have been received and paid in full. 10. The Client certifies that he/she is the sole owner of the mare, or has full authority to enter into this contract, on behalf of the owner(s). 11. When Winding Oaks Welsh & Sportponies, by its authorized representative, signs and returns a copy of the contract to the client, it will become the binding contract of both parties. This contract is not transferable or assignable without the permission of Winding Oaks Welsh & Sportponies. This contract is entered into, in the State of Florida, County of Levy. All legal processes must be taken in the State of Florida, County of Levy. 12. Please note that all payments are to be made payable to Leah McFarlin.
